Read carefully — this is the legal grant of rights.
Release For Use:
Thank you for agreeing to participate in and/or record and submit a video of yourself responding to other prompts provided by Rabbit Hole Productions, LLC, and/or its affiliated companies, parents and subsidiaries and/or their respective designees, licensees and assigns (collectively, “Producer”) in connection with the production of a currently untitled Cartoon Network Docuseries (the “Production”). This release confirms the terms of your participation in the Production.
1. You acknowledge that you may be photographed, recorded and/or videotaped by Producer and/or its representatives in connection with the Production and/or you may submit to Producer photographs, recordings and videos (all such photographs, recordings and video footage shall hereinafter collectively be referred to as the “Photographs”). You hereby grant Producer the sole and exclusive right to use and incorporate the Photographs, in whole or in part, in conjunction with other photographs and/or videotape footage, in the Production and the unlimited right to reproduce, broadcast, exhibit or use the Photographs and the Production, in whole or in part, in any and all media, whether now known or hereafter devised, including but not limited to theatrically, on television, videocassettes and interactive media throughout the universe, by any and all methods whatsoever without limitation, whether now known or hereafter devised, in perpetuity, and to authorize others to do so, and you hereby grant Producer the right to use your name, voice, likeness and/or biographical information (collectively “Likeness”) in the Production and in connection with the distribution, exhibition, advertising and promotion of the Production and for institutional advertising. Notwithstanding any of the foregoing, Producer shall be under no obligation to actually use or exploit any or all of the Photographs or your Likeness.
2. The Photographs shall be the sole and exclusive property of Producer or its designee, and Producer shall be entitled to sole and exclusive ownership thereof and of the copyright and all rights of copyright and copyright renewal therein. In this regard, the Photographs shall be deemed created for the benefit of Producer as a work made for hire. To the extent not recognized as a work made for hire, you hereby assign all rights in and to the Photographs to Producer, throughout the universe in perpetuity, including, without limitation, all rights of copyright.
3. The rights granted herein shall inure to the benefit of Producer, its licensees, successors and assigns, and all such rights shall be freely assignable by Producer.
4. In the event of a breach of this Release by Producer, your rights and remedies shall be strictly limited to the right, if any, to recover damages in an action at law, and you shall not be entitled to injunctive or other equitable relief.
5. The rights granted in this Release are in addition to, and shall not limit nor be construed as prejudicial to, Producer’s rights or privileges as a member of the public. This Release constitutes the entire agreement between you and Producer with respect to the subject matter hereof and supersedes all prior agreements, whether oral or written, pertaining to same. In signing this Release, you agree that you are not relying on any representations or other statements that are not contained herein.
